On April 27, 2016, The Leadership Conference filed a brief urging the Court to defer to the EEOC Guidance and affirm the decision of the district court, arguing that the widespread use of criminal background checks by employers has a devastating and disproportionate effect on minority communities and the 2012 EEOC enforcement guidance on employer consideration of arrest & conviction records merits Skidmore deference.
