On January 13, 2012, The Leadership Conference filed a brief in conjunction with the NAACP Legal Defense and Education Fund, et al., supporting the United States’ position that the Eleventh Circuit erred in its analysis of Congress’s power to enact the minimum coverage provision under the Commerce and Necessary and Proper Clauses.  Further, we argued the ACA’s minimum coverage provision enhances the ability of individuals to participate in the economic, social, and civic life of our nation, thereby advancing equal opportunity and personal liberty.
