On January 28, 2016, The Leadership Conference filed a brief urging the Court to affirm the district court’s decision granting summary judgment to the government, arguing that the Section 8(a) Program is necessary to chief the government’s compelling interest in eliminating discriminatory barriers faced by minority-owned businesses, and the Section 8(a) Program is narrowly tailored to remedy the effects of discrimination on minority business development.
