Vote Recommendation: Oppose H.J.Res.98, Providing for Congressional Disapproval of the NLRB Rule “Standard for Determining Joint Employer Status”
Dear Member of Congress,
The Leadership Conference on Civil and Human Rights, a coalition of more than 240 national organizations committed to promoting and protecting the civil and human rights of all persons in the United States, urges you to oppose H.J.Res.98 when it comes up for a vote in the House. The legislation, which provides for congressional disapproval of the NLRB Rule “Standard for Determining Joint Employer Status,” would harm a broad range of workers, but would have particularly damaging impacts for women, Black workers, immigrants, people of color, and people with disabilities who disproportionately hold precarious, low-paid jobs. Policymakers must reject the resolution providing for congressional disapproval of the rule. The Leadership Conference intends to include your position on H.J.Res.98 in our voting records for the 118th Congress.
As we explained in a letter sent alongside other advocates in November, this rule is a major step toward safeguarding the labor rights of millions of workers in subcontracted employment, ensuring that corporations cannot skirt the law simply by outsourcing responsibility for their workers. The Leadership Conference supports the rule, which brings coverage in line with the longstanding scope of common-law definitions of employer, furthers the intent of the National Labor Relations Act, and ensures that federal labor law is responsive to the needs of low-wage workers. H.J.Res.98 would weaken workers’ ability to hold employers accountable, which will cause disproportionate harm to the communities our coalition represents.
For these reasons, we urge you to vote against H.J.Res.98. We intend to score this vote in our voting records.
