The Leadership Conference Filed an Amicus Brief in Advisory opinion to the Attorney General: Amendment to Bar Government from Treating People Differently Based on Race in Public Education

On July 13, 2000, The Leadership Conference filed a brief arguing that an initiative petition should address only one subject for a consumer’s vote and that the FL Secretary of State’s proposed amendment actually called for a vote on three subject areas – public education, public employment, and public contracting – in violation of the state constitution.  Second, that the proposed amendments violate the state constitution because if the electorate approves the proposed amendments, preferential treatment would be prohibited on the basis of the enumerated classifications, but permitted on the basis of religion and physical disability – the remaining classifications in the current constitutional provision – resulting in discriminatory preferences.
